01 Who we are
The site is operated by The Legacy of Bert Foundation ("we," "us," or "our"), the entity responsible for the $BERT brand and the bert.global website. References to "$BERT," "Bertram," "the token," or "the project" describe the community token and ecosystem connected to Bertram the Pomeranian. References to "you" mean any visitor or user of the site.
02 Acceptance and eligibility
By using the site you confirm that you are at least 18 years old (or the age of majority where you live) and have the legal capacity to enter into these terms. You also confirm that your use of the site, and any interaction with the $BERT token, is permitted under the laws of your country and region. You are responsible for checking that participation is legal for you, and we may restrict access from jurisdictions where it is not. We reserve the right to restrict or prohibit access to the site, ecosystem features, or related services by persons or entities located in jurisdictions subject to sanctions, embargoes, or other legal or regulatory restrictions, or where such access would otherwise expose us to legal or compliance risk.
03 Intellectual property and ownership
All material on the site, including text, artwork, illustrations of Bertram, graphics, logos, the $BERT name and marks, page designs, layouts, and underlying code, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. All rights that are not expressly granted to you in these terms are reserved.
You may not copy, reproduce, republish, sell, sublicense, distribute, modify, or otherwise commercially exploit any part of the site without our prior written permission.
We grant you a limited, personal, non-exclusive, non-transferable, and revocable licence to access and view the site for your own personal, non-commercial use. This licence does not transfer any ownership to you and ends automatically if you breach these terms.
05 Trademarks
The $BERT name, the Bertram character and imagery, and all related logos and marks shown on the site are our trademarks or trade names, whether registered or not. Nothing on the site grants you any right or licence to use any of these marks without our express written permission. Other product and company names mentioned on the site may be the trademarks of their respective owners.
06 Community content and submissions
If you send us feedback, ideas, suggestions, artwork, memes, or other materials, you agree that, unless we have agreed otherwise in writing, these are non-confidential and that we may use, reproduce, adapt, publish, and distribute them without restriction and without any obligation or payment to you. You confirm that anything you submit is your own and does not infringe anyone else's rights.
07 Nature of the $BERT token
$BERT is a community meme token primarily intended for entertainment, community participation, and cultural engagement. It is intended as a cultural and participatory asset, not as an investment.
$BERT is not a security, share, bond, deposit, fund, e-money, or regulated financial instrument.
Holding $BERT does not give you any ownership of, equity in, or claim against us, and does not entitle you to dividends, profit, revenue, or any guaranteed return.
We do not promise that $BERT will hold or increase in value. Its price is set by the open market and by third parties we do not control.

We are not your broker, adviser, or fiduciary. You should do your own research and, where appropriate, consult an independent professional before making any decision. Any decision you make about $BERT is made at your own risk and judgement.
09 Risk disclosure
Digital assets and blockchain activity carry significant risk. By using the site or interacting with $BERT, you acknowledge and accept that:
Prices are highly volatile and can fall to zero. You may lose some or all of the value you hold.
Blockchain transactions are generally irreversible. Sending funds to the wrong address or contract can mean permanent loss.
You are solely responsible for the security of your wallet, private keys, and seed phrases. We can never recover them for you.
Smart contracts, bridges, and protocols may contain bugs or be subject to exploits, and on-chain activity is public and permanent.

10 Staking, NFTs, and ecosystem features
The $BERT ecosystem may include features such as token and NFT staking, an NFT collection, smart dog tags, and the Woofhub platform. Where these are available, you use them at your own risk. Any rewards, mechanics, or features are subject to change or discontinuation, are not guaranteed, and may depend on third-party infrastructure and smart contracts that we do not fully control. Participation in staking may involve smart contract, validator, technical, market, and regulatory risks. NFTs and staked assets are typically held and managed through non-custodial smart contracts, meaning you retain responsibility for your own wallet and interactions.
11 Charitable initiatives
$BERT supports charitable causes connected to the welfare of dogs. Descriptions of donations, partnerships, and charitable activity reflect our intentions and past efforts and are provided in good faith. The nature, timing, and amount of any charitable giving is discretionary and may change. Statements about charitable impact are not a binding commitment, a financial promise, or a basis on which to expect any return from holding $BERT.
12 Third-party links and services
The site may link to or rely on third-party services such as exchanges, decentralised exchanges, wallets, bridges, analytics tools, and social platforms. We do not control these services, do not endorse them by linking to them, and are not responsible for their content, security, availability, fees, or practices. Your use of any third-party service is governed by that party's own terms and is entirely at your own risk.
13 Acceptable use
When using the site, you agree that you will not:
copy, modify, decompile, reverse engineer, or attempt to extract the source code of any part of the site;
use bots, scrapers, or other automated systems to access the site without our permission;
use the site for any unlawful, fraudulent, or harmful purpose, including market manipulation, money laundering, or impersonation;
introduce malware, attempt to gain unauthorised access, or interfere with the site's normal operation; or
infringe our intellectual property or the rights of any third party.

15 Force majeure
We will not be liable for any delay, interruption, failure, or inability to perform any obligation or provide access to the site, the $BERT ecosystem, or any related features where such delay, interruption, failure, or inability results from events beyond our reasonable control. These events may include, without limitation, blockchain network failures, validator outages, smart contract vulnerabilities, cyberattacks, denial-of-service attacks, internet or telecommunications failures, software or hardware malfunctions, natural disasters, pandemics, acts of government, regulatory actions, war, civil unrest, labour disputes, power outages, or failures of third-party service providers.
16 Limitation of liability
To the maximum extent permitted by law, we and our team, contributors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, funds, tokens, data, or goodwill, arising from or connected to your use of the site or your interaction with $BERT, even if we have been advised of the possibility of such loss. Nothing in these terms excludes any liability that cannot be excluded under applicable law.
17 Indemnity
You agree to indemnify and hold The Legacy of Bert Foundation and our team and affiliates harmless from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your use of the site, your interaction with $BERT, or your breach of these terms or of any applicable law or third-party right.
18 Changes to these terms
We may update these terms from time to time. When we do, we will revise the "last updated" date above. Changes take effect when posted, and your continued use of the site after that means you accept the updated terms. We encourage you to review this page periodically.
19 Governing law
These terms and any dispute arising from your use of the site are governed by the laws of the Cayman Islands, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of the Cayman Islands for the resolution of any such dispute.
